ASPRESO’S TERMS AND CONDITIONS
a. Every order placed with Aspreso by means of this website (“our Website”) shall be governed by these Terms and Conditions (“T&Cs”). By using our Website to place an order, you acknowledge that you have read, understood and accepted our T&Cs without reservation.
c. We reserve the right to amend these T&Cs by posting a new version on our Website. Should you place an order after we have posted a new version these T&Cs, you agree to be bound by the amended version.
2. ORDERS PLACED ON OUR WEBSITE
a. Placing an order on our Website constitutes an offer to purchase the products you have selected on our Website under these T&Cs.
b. We offer products on our Website subject to availability of stocks. All orders are therefore subject to acceptance (by us) and availability of stocks.
c. Items in your cart are not reserved and may be purchased by other customers before the order confirmation is issued by Aspreso.
d. The order you place on our Website will not constitute a binding contract unless and until Aspreso transmits a confirmation by e-mail.
e. Aspreso reserves the discretionary right to refuse orders, notably in relation to creditworthiness or unpaid invoices.
f. The order Aspreso receives on our Website constitutes full proof of the order and the entire transaction. The information registered by the payment system constitutes full proof of the financial transactions.
a. Prices listed on our Website are in Singapore Dollars (SGD).
b. The prices payable for the items you order are those displayed on our Website on the date you place your order, excluding delivery charges.
c. Delivery charges may be indicated on our Website. In any case, any delivery charge will be made known to you at the time of placing your order. The delivery charge will be calculated based on the size of the order, the delivery method and your location.
d. Aspreso reserves the right to modify its prices and delivery charges at any time.
4. TAXES AND DUTIES
a. All export taxes and duties, where applicable, will be borne by us.
b. You are the importer on record and must comply with all laws and regulations of the country in which you are receiving the goods. You may be subjected to import duties and taxes that are levied once the merchandise reaches your country which are payable by you. Any additional charges for customs clearance must be borne by you. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information.
a. All orders confirmed by Aspreso will be delivered to the delivery address specified by you when you place your order on our Website.
b. During the time the goods are in transit before it is delivered to your specified delivery address, the goods will be insured.
c. Aspreso may or may not require a signature for any goods delivered. Where a signature is required, responsibility for your purchased goods passes to you upon the signing of the goods. If you have specified a recipient who is not yourself for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) as evidence of delivery and fulfilment of the order by Aspreso, and transfer of responsibility in the same way.
d. For orders placed through methods or platforms other than through Aspreso’s website or through the direct liaison with Aspreso or its representatives, any conflicting terms could be superseded by the terms of the vendor or Aspreso respectively.
6. VERIFICATION OF MERCHANDISE
a. It is your responsibility to verify the quantity and condition of the merchandise upon delivery.
b. In case you observe damaged or missing items, you must inform Aspreso within 7 days after taking delivery. After verification that the products are indeed damaged or missing, Aspreso shall in such case provide you with replacement products.
a. Payment shall be made in full via the Aspreso PayPal payment gateway in order for the order to be confirmed.
b. Payment by credit card is immediately due and payable. Your credit card details will be encrypted for security purposes.
c. Payment can be made by Visa, MasterCard, American Express, Visa Debit, PayPal to PayPal transfer and any other methods which are agreed upon between Aspreso and you. Payment will be debited and cleared from your account upon payment. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Aspreso, we will not be liable for any delay or non-delivery of your order.
d. In the absence of negligence on our part, Aspreso shall not be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from our Website.
e. Aspreso reserves the right to refuse to process and accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from our Website whether or not that merchandise has been sold, or by removing, screening or editing any materials or content on our Website, or by refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
8. LIMITATION OF LIABILITY
a. We provide our Website on an “as is” basis and make no representations as to the quality, completeness or accuracy of any content made available on the Site. To the maximum extent permitted by law, we expressly exclude:
i. all conditions, warranties and other terms that might otherwise by implied by law into these T&Cs; and
ii. any and all liability to you, whether arising under these T&Cs or otherwise in connection with your use of the our Website.
b. For international deliveries, Aspreso shall not be liable if the products do not comply with the existing laws and regulations of the country of delivery.
c. Without limiting the scope of these T&Cs, no claim of any kind, whether as to products delivered or non-delivery of products, or otherwise, shall be greater in amount than the purchase price of the products in respect of which damages are claimed.
d. Aspreso shall not be liable for any direct, indirect, incidental or consequential damages of any nature, capable of arising in connection with its products, their use, sale or our Website.
f. For orders placed through methods other than through Aspreso’s website or through the direct liaison with Aspreso or its representatives, the terms and conditions and privacy statement of the relevant site owner(s) shall also apply on top of the terms and conditions and privacy policies declared by Aspreso.
9. FORCE MAJEURE
a. Aspreso shall not be held responsible for delays or failure to deliver caused by circumstances beyond its reasonable control. Such circumstances include, but are not limited to, strikes, wars, natural catastrophes or any others that make impracticable the production, transportation or delivery of products.
b. In the event of delay, Aspreso will perform its obligations as soon as reasonably possible, and it reserves the right to allocate any remaining product supply among customers in a fair and reasonable manner.
10. RIGHTS OF THIRD PARTIES
a. A person who is not a party to these terms and conditions has no right under the Contracts (Rights of Third Parties) Act, Chapter 53B of Singapore to enforce any of the provisions under these T&Cs.
11. GOVERNING LAW AND JURISDICTION
a. These T&Cs will be governed by and construed in accordance with the laws of Singapore, and the courts of Singapore will have exclusive jurisdiction over any claim or dispute arising out of or in connection with these T&Cs.
